Introduction

This service allows the parties to a construction contract to jointly appoint an experienced and neutral dispute resolution practitioner—often a senior construction professional, lawyer, or adjudicator—who works proactively during the life of the project. The goal is to resolve disputes early, maintain working relationships, and realign the project for successful completion.

Early Intervention and Ongoing Involvement

This may include entitlement to extensions of time, variations, or claims for additional payment.

Agreement on a Revised Completion Programme

Once historic issues are resolved, the practitioner facilitates agreement on a new programme to completion.

This includes realistic timelines, resource planning, and risk mitigation strategies.

Revised Contract Sum

The parties agree on a revised contract sum that reflects the outcomes of the dispute resolution process and the new programme.

This may include revaluation of works, settlement of claims, and adjustments for risk.

Preservation of Relationships

The process is collaborative and non-adversarial.

The practitioner fosters open communication, trust, and mutual respect between the parties.

Confidential and Without Prejudice

Discussions and outcomes are confidential and conducted on a “without prejudice” basis, encouraging honest dialogue.
